Sense.Amsterdam (the “Site” or “we”) collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site.

COLLECTING PERSONAL INFORMATION

When you visit the Site, we collect certain information about your device, your interaction with the Site, and the information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”. Device information

MINORS

USING PERSONAL INFORMATION

AUTOMATIC DECISION-MAKING

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
  • Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. WEBSHOP

 

SHOPIFY

Our webshop is built using software from Shopify. Personal data that you provide to us for our services is shared with this party. Shopify has access to your data to provide us with (technical) support. They will never use your data for any other purpose. Shopify is obligated by the agreement we have with them to take appropriate security measures, including SSL encryption and a strong password policy. Shopify is a certified processor of credit card data. Shopify uses cookies to collect technical information about your use of the software. No personal data is collected and/or stored. Shopify reserves the right to share collected data within its corporate group to improve services. The EU/US Privacy Shield applies, and your data may be processed in the United States.

WEBHOSTING


We use web hosting and email services from Strato Mail. Strato Mail processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata about the use of the services. These are not personal data. Strato Mail has implemented appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. Strato Mail is obligated to maintain confidentiality under the agreement.

PAYMENTS

We use Shopify Payments to handle (part of) the payments in our webshop. Shopify Payments processes your name, address, and residence details, as well as your payment details such as your bank account or credit card number. Shopify Payments has taken appropriate technical and organizational measures to protect your personal data. Shopify Payments reserves the right to use your data to improve its services and share (anonymized) data with third parties. Shopify Payments shares personal data and financial information with credit agencies in the event of a deferred payment request (credit facility). The safeguards regarding the protection of your personal data also apply to services for which Shopify Payments engages third parties. Shopify Payments retains your data only as long as legally permitted.

LOGISTICS

PostNL
If you place an order with us, it is our responsibility to have your package delivered to you. We use PostNL for delivery services. It is necessary to share your name, address, and residence details with PostNL. PostNL uses this data solely to fulfill the agreement. If PostNL engages subcontractors, PostNL also provides your data to these parties.

DHL
We use DHL for shipping. Your name, address, and residence details are shared with DHL for delivery purposes only. If DHL engages subcontractors, your data is shared with these parties as well.

GLS
We use GLS for delivery services. Your name, address, and residence details are shared with GLS solely for the execution of the agreement. If GLS engages subcontractors, they will also receive your data.


EXTERNAL SALES CHANNELS

We use your data solely to provide our services. This means that the purpose of the processing is always directly related to the order you place. We do not use your data for (targeted) marketing without explicit consent. Your data is shared with third parties only to meet accounting and administrative obligations. All third parties are bound to confidentiality by agreement or legal obligation.


Cooperation with Fiscal and Criminal Investigation

In certain cases, Sense may be legally required to share your data in connection with government fiscal or criminal investigations. In such cases, we will oppose sharing your data within the limits of the law.

Under Dutch and European law, you have certain rights regarding your personal data. These include:
